AUCTION TERMS AND CONDITIONS
The following terms and conditions apply to all Buyers and Sellers while either list alpacas for sale on the Eastern Alpaca MARKETING Group ( E.A.M.G. ) auction website . EAMG is an independent marketing group which from time to time hosts a website where individuals and /or companies can lists for sale alpacas. EAMG represents neither Buyer or Seller , and make no warranties as to the fitness for a particular purpose , any warranties to merchantability , any representation as to the health of the alpacas listed on its website , or any warranties of any kind .
- The following terms and conditions , as amended by any posted notices or announcements by the site administrator and or administrators during the auction will constitute the entire agreement between Eastern Alpaca Marketing Group and the seller and buyer.
- Every effort has been made to ensure the correctness of all Eastern Alpaca Marketing Group auction website listings.
- Any representation or information presented by Eastern Alpaca Marketing Group in any advertisements or announcements or other medium employed does not constitute a warranty, guarantee or representation from Eastern Alpaca Marketing Group regarding or determining whether to enter the alpaca in the auction.
- Buyer and seller agree to hold Eastern Alpaca Marketing Group harmless and free from any liability for any defect or problem in quality of alpaca entered in the auction.
- Eastern Alpaca Marketing Group is not a representative of either the buyer or the seller. Eastern Alpaca Marketing Group makes no warranties or implied warranties to the fitness of any entry for a particular purpose or of the merchantability. Neither Eastern Alpaca Marketing Group or their administrators can give any warranties expressed or implied as to the quality or description of the alpaca being listed for sale. Eastern Alpaca Marketing Group does not guarantee the soundness of any alpaca or the birthing of any female.
- Buyer and seller both acknowledge they have not relied on any representation from Eastern Alpaca Marketing Group regarding the determining whether to enter the alpaca in the auction.
- Sellers have signed an agreement stating that all information submitted is accurate and true to the best of there knowledge. Eastern Alpaca Marketing Group will not be held responsible for any discrepancies or errors and / or omissions and do not assume any liability on its part or the part of the seller for any written or verbal statements made regarding any alpacas listed for sale.
- Neither the auction site designer, website administrators or any agents in any way , make any representation or warranties with respect to the sale of any listed alpaca. Any an all warranties listed are solely made by the sellerAny person entering the auction website as an observer or participant in any way shall do so at there own risk, and no liability, duties or obligations and / or responsibilities shall be imposed on Eastern Alpaca Marketing Group, their administrators or designers for any injuries, accidents, theft or any harm regardless of cause.
- Any dispute between buyer and Eastern Alpaca Marketing Group or Seller and Eastern Alpaca Marketing Group or between buyer and seller wherein Eastern Alpaca Marketing Group is named as a third party, will be governed by the then said laws of the state of Virginia.
- All sales constitute a contract between buyer and seller only of each alpaca sold and that Eastern Alpaca Marketing Group is not a party to the contract between the buyer and seller, either as a signatory or as a third party beneficiary. Buyers and Sellers will enter into a contract solely between themselves.
- Eastern Alpaca Marketing Group assumes no responsibility, legal or otherwise, in regard to the sales contract. Buyer and seller further agree to hold Eastern Alpaca Marketing Group harmless and free from any liability for any and all claims regarding the failure on the part of the buyer or seller to perform the terms of any sale, including, but not limited to any claim for rescissions, fraud, negligent misrepresentation, breach of warranty, breach of contract, failure to deliver animal and breach of any implied warranties. Buyer and seller agree to hold Eastern Alpaca Marketing Group harmless and free from any liability for problem in quality or defect of any animal.
- Eastern Alpaca Marketing Group reserves the option to make changes and amendments to the terms and conditions of the auction and to make updates and changes to the alpacas listed for sale in the auction . Buyer and Sellers are instructed to refer to the website frequently for updates and amendments.
- The above terms and conditions apply to all Buyers and Sellers while either list alpaca (s) for sale on the Eastern Alpaca Marketing Group auction website.
- Buyer and Seller agree to hold EAMG harmless for any liability or damages sustained by reason of any purchase or sale of any alpacas listed on EAMG’S auction website.
- By registering as a bidder : bidder / buyer signifies agreement to all buyer terms and conditions and all auction terms and conditions. By listing alpacas as a seller ; seller agrees to all seller terms and auction terms and conditions.
